GENERAL TERMS AND CONDITIONS
- The John Graham Software free-site offer is offered to you conditioned on your acceptance without modification of these Terms and Conditions. Your use of the John Graham Software free-site offer constitutes your agreement to these Terms and Conditions.
- All content that is designed by John Graham Software and is used on the free-site will be Copyright of John Graham Software with the exception of customer-supplied artwork and information.
- You will allow us to place a small advertisement for John Graham Software at the bottom of the page. John Graham Software reserve the right to change this advertisement at any time.
- John Graham Software will host the site for you at no cost for one calendar year, a charge of £25.00 will be payable each calendar month after this period, any free site not paying this fee will be removed immediately.
- All free sites hosted by John Graham Software will have a limit of 500Mb of bandwidth per month. Any site exceeding the quota will be charged at £1.00 per 1Mb per 24 hours.
- The free site cannot be hosted by any other organisation.
- The free site cannot link to any pages not hosted by John Graham Software.
- Any requested updates must not be in contravention of the Terms and Conditions.
- John Graham Software reserve the right to refuse any site that John Graham Software deem unsuitable, for example:
- Those that would violate any applicable law, regulation or third party right;
- Those encouraging illegal activity or racism;
- Those that promote or utilize software or services designed to deliver unsolicited e-mail;
- Those advertising any materials, products and/or services related to pornography.
- Links to other web sites and/or pages of the internet is not permitted.
MODIFICATION OF THESE TERMS AND CONDITIONS
- John Graham Software reserves the right to change the Terms and Conditions at anytime, effective upon making the modified provisions available on the John Graham Software web site. You are responsible for regularly reviewing these terms and conditions. Continued use of the John Graham Software free-site offer after any such changes shall constitute your consent to such changes. John Graham Software does not and will not assume any obligation to notify you of any changes to the Terms and Conditions.
NO UNLAWFUL OR PROHIBITED USE
- As a condition of your use of the John Graham Software free-site offer, you warrant to John Graham Software that you will not use the John Graham Software free-site offer for any purpose that is unlawful, or prohibited by these Terms and Conditions (as the same may be modified from time to time). In addition, you may not link to the free-site any site containing an inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information, or material or information that violates any applicable intellectual property, proprietary, privacy or publicity rights.
LIABILITY
- John Graham Software shall have no liability for the accuracy of the information contained in the free site, or for delays or omissions therein. None of the foregoing parties shall be liable for any third party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. John Graham Software reserves the right to remove any item in its database that is not deemed appropriate, or abuses the decency of Internet etiquette. John Graham Software is not responsible for any losses or liabilities associated with the free site.
- You agree to defend, indemnify and hold John Graham Software harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of these Terms and Conditions, or any third-party's rights, (including, without limitation, infringement of any copyright, violation of any proprietary right and invasion of any privacy rights). These obligations will survive any termination of your relationship with John Graham Software.
